Terms of Service

How the service works and how it may be used.

Effective October 17, 2026

1. Agreement to these terms

These terms form an agreement between Identity Entry and the business that creates an account or uses the service. By creating an account, buying checks or using the console, API or MCP server, you agree to these terms on behalf of your business. If you do not have authority to bind your business, do not use the service.

2. Accounts

  • You must give accurate information when you create an account and keep it up to date.
  • You are responsible for everything that happens under your account, including the actions of your team members and anyone using your API keys.
  • Keep passwords and API keys private. Keep API keys on your own servers and never place them in browser code.
  • Tell us through the contact page right away if you believe your account has been accessed without permission.

3. The service

Identity Entry checks a person's ID, face and liveness, plus any extra checks you turn on, and returns a result of Pass, Caution or Fail with the reasons. The same checks are available through the website, the API and the MCP server.

A check that cannot be completed is never counted as a Pass. Your workspace policy decides whether it becomes Caution or Fail.

We may improve, change or add features over time. If we remove a feature you rely on in a way that materially reduces the service, we will give you reasonable notice.

4. Pricing

Identity Entry offers three products:

  • Verify: $1 per person. Covers the ID, face match and liveness check, with one Pass, Caution or Fail result, including a check that runs inside your checkout.
  • Access: $2 per person on each event, building or departure list, whether or not the person is ever scanned at the door. Covers the check when the person buys a ticket and the face match at the door. Bought ahead by the number of people you expect.
  • Shield: $100 a month per business, billed monthly. Keeps Chargeback Evidence Records of your completed Verify checks, with dispute packages and PDF export.

Event entry is $2 per person. Identity Entry reserves the right to change this price with notice.

Prices are the same on the website, the API and the MCP server. Prices are in US dollars and do not include taxes, which are added where required.

5. Purchases and payment

  • Checks are bought in advance as a block. Prepaid checks never expire and can be used whenever you are ready.
  • Shield renews each month until you cancel. When you cancel, Shield stays on until the end of the month you paid for and does not renew.
  • Payment is processed by our payment provider. By paying, you authorize the charge for the block you selected.
  • If we change prices, the new prices apply to purchases made after the change. Checks you already bought keep the price you paid.

6. Acceptable use

You must follow the Acceptable Use policy, which forms part of these terms. In short, use Identity Entry only to check people who have agreed to confirm who they are for a legitimate reason.

7. Your responsibilities

  • Lawful purpose: have a lawful reason for every check you request.
  • Notices and consent: give people every notice and obtain every consent the law requires, including any written consent required for biometric information and any notices required for background checks.
  • Accurate requests: send checks only to the people they are meant for.
  • Your own legal duties: comply with privacy, consumer reporting, employment, housing, anti-discrimination and other laws that apply to how you use results.
  • Testing: a decision recorded in a workspace changes the real check record. While trying the product, use clearly made-up test details and sample images.

8. Results and decisions

Identity Entry gives you information to support a decision. The decision is yours. You remain responsible for every decision you make about a person, including whether to accept, decline or review them, and for any action you take based on a result.

A Caution result means a person on your team should review the check before deciding. Background search matches are always returned as Caution because a name match can belong to someone else.

9. Availability and support

We work to keep Identity Entry available and responsive, but the service may occasionally be unavailable because of maintenance, updates, problems with our providers or events outside our control. We do not promise any specific uptime. For help, use the contact page.

10. Suspension

We may suspend access to all or part of the service if we reasonably believe your account is being used in breach of these terms or the Acceptable Use Policy, poses a security risk, or must be suspended to comply with the law. Where it is practical and lawful, we will tell you why and give you a chance to fix the problem first.

11. Intellectual property

Identity Entry and its software, design, documentation and content belong to Identity Entry. We grant you a limited, non-exclusive, non-transferable right to use the service for your business while these terms are in effect.

You keep all rights to the information you and the people you check provide. You give Identity Entry permission to process that information only as needed to provide the service. If you send us feedback, we may use it without any obligation to you.

12. Confidentiality

Each party will keep the other party's non-public information confidential, use it only to perform under these terms, and protect it with reasonable care. This does not apply to information that is public, already known, independently developed or lawfully received from someone else, or that must be disclosed by law.

13. Disclaimers

Identity verification depends on the quality of photos, documents and public sources, none of which are perfect. Except as stated in these terms, the service is provided as is and as available. To the extent the law allows, Identity Entry disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement, and does not promise that every result will be accurate or that the service will be uninterrupted.

14. Limitation of liability

To the extent the law allows, Identity Entry will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from these terms or the service. Identity Entry's total liability for any claim will not exceed the amount you paid for checks in the 12 months before the event giving rise to the claim. These limits do not apply where the law does not allow them.

15. Indemnity

You will defend and indemnify Identity Entry against claims by third parties arising from your use of the service in breach of these terms, from decisions you make based on results, or from your failure to give notices or obtain consents the law requires.

16. Ending the agreement

You may stop using the service and close your account at any time. We may end these terms if you materially breach them and do not fix the breach after notice, or immediately where the law requires it. When the agreement ends, your access stops, and stored information is kept as described in the Data Retention policy. Sections that by their nature should continue, including payment, confidentiality, disclaimers, limitation of liability and indemnity, survive.

These terms are governed by the laws of the state where Identity Entry is organized, without regard to its conflict of law rules. We may update these terms and will give notice of material changes before they take effect. For questions, use the contact page.

17. Keeping identity profiles

When a person completes an Identity Entry check, their identity profile, including ID photos, selfies and the face record made from them, is kept for up to 10 years after the person's most recent check, so a returning person can be confirmed without starting over. A person can have it deleted sooner at any time by emailing team@identityentry.com or by deleting their Identity Entry account. Where a state law sets a shorter period for biometric information, such as Illinois, Identity Entry follows that shorter period for residents of that state. A deletion request is completed once the person's identity is confirmed.
